能够参加这次卓有声望的论坛和这些特别庆祝活动是我的莫大荣誉和荣幸。我谨代表我自己以及来自英国和世界各地的同事们衷心感谢徐显明校长的盛情邀请和一贯的热情好客。我想在此转达我在牛津大学法学院的同事们对您，校长先生，和您在中国政法大学的所有同事们的友好问候，这些问候不仅来自John Finnis教授，还来自Oriel学院的同事们，包括令人尊敬的Oriel学院院长、牛津大学前副校长Ernest Nicholson教授。
我还要特别高兴的报告，牛津大学副校长，Colin Lucas博士，曾写信给我希望我在方便的场合转达牛津大学对中国政法大学校长先生和其他同仁的校庆祝贺和对贵校在将来继续发展繁荣的祝愿。我非常愿意在这个庆祝中国政法大学50年校庆的隆重典礼上完成这个愉快的任务，我将另外向徐显明校长转交牛津大学副校长先生表达他美好祝愿和祝贺的信件。我们祝愿徐显明校长和您在北京的全体同事，不仅在贵校历史上这个特殊的时刻，并且在将来为培育同适格的国外机构的关系和寻求提升中国政法大学的声望使之成为世界级的法学院和卓越的国际性中心的所有努力取得成功。尽管被不同的历史、文化和语言所分隔，全世界的法学家们仍然能够很容易地认同卓越的法律学识的高标准，对此，你们完全有理由为由你们的三位最杰出的终生教授，民商法领域的江平教授，刑事法律领域的陈光中教授——这个学科也是我本人特别感兴趣的领域，和著名的法制史学家张晋藩教授，以及徐显明教授，你们的精力充沛并且富有魅力的校长先生为代表的卓越成就感到骄傲。徐校长研究的法理学是我感兴趣的另一个领域，我在您最近对牛津大学访问时非常好奇地从您了解到中国最缺乏的不是法律工匠，而是对法律原则的专门知识和理解。这是与这所杰出的法学院在头50年里的良好传统相称的教育上的挑战，我们祝愿您取得成功。
我并非假设我能够出席中国政法大学百年华诞的庆典，但我可以想象将来的五十年、甚至是将来的十五年对于中国的法律学者和从业者将是非常令人振奋的。几年前我读过一份法律报告中的一段文字，我联系之前我未曾接触过的和约关系的离奇的普通法学说研究它，这使我非常细心的反思。这个案件以“先锋号集装箱船案”闻名。该案是由枢密院审理的来自香港上诉法院的上诉案件，载于《法律报告1994》上诉案件第二卷第324页以后。其法律问题是转受托人是否有权依赖一个排他管辖条款，但是那段吸引人的文字是：“本提单合同由中国法律管辖”。在此之前我遇到的法律选择条款总是规定英国法律为合同适用法。这个案件使我明白一位二十一世纪的有见识的律师必须像熟悉英国合同法一样有效地掌握中国合同法知识。由于中国加入世界贸易组织，我觉得一切都更加密切相关，一个事实例证是，校长先生就已经使我在牛津大学的几位同事对中国的法律和法律教育产生了强烈的兴趣。我认为没有什么比时间更适于拉近我们两种法律文化的之间的距离了。
为了缩短一点不同法律文化之间的距离目的，依靠David Peterson先生的超乎寻常的慷慨——对David Peterson先生我要表达我个人的感激，对于他推动对中国律师的英国法律教育的承诺我钦佩之至——我们已经接受了几名非常有能力的中国学生到Oriel学院学习法律。请允许我把Paloma Wang, Frank Cui和Ruby Li称为中国政法大学的三位出色的代表和大使。对于一位导师，帮助这样有能力和忠诚的学生非常愉快。因此我要利用这个机会感谢他们在北京的教授们的出色的教育。你们的工作使我的任务变得非常轻松！他们三位很快还要加上陈剑——我称他为Matthew——他为我作出的不知疲倦的努力使我对中国的第一次访问愉快而难忘。他安排我访问了西安附近的秦始皇兵马俑，乘船从重庆到武汉游览了磅礴的长江。他的这些安排准确并有品位。从我已经对这个年轻人所做的观察判断，我相信他在牛津大学的法律学习将会非常成功。

It is an honour and a privilege to participate in this prestigious forum and in these special anniversary celebrations. On behalf of myself and my colleagues from Britain and the rest of the world, I thank President Xu Xianming most warmly for his generous invitation and institutional hospitality. I convey friendly greetings from my colleagues in the Law Faculty at Oxford University, not least Professor John Finnis; and also from colleagues in Oriel College, not least the Reverend Professor Ernest Nicholson, Provost of Oriel College and a pro-Vice-Chancellor of Oxford University to you, Mr President and all your colleagues here at the China University of Political Science and Law. I am most especially pleased to report that the Vice Chancellor of Oxford University, Dr Colin Lucas, has written to me to say that he would be glad if I would convey to the President of CUPL and others in a convenient forum the congratulations of Oxford University on your anniversary and express our hopes that your University will continue to flourish in the future. I am extremely happy to discharge that pleasant duty in this remarkable and convenient forum on the occasion of the 50th anniversary of the China University of Political Science and Law and personally to deliver to President Xu Xianming the
Vice-Chancellor's letter of good wishes and congratulations
We wish you, Mr President and all your colleagues here in Beijing every success in your endeavours not only on this very special occasion in the history your University but in years to come as you continue to nurture relationships with appropriate institutions in other countries and seek to enhance the reputation
of the China University of Political Science and Law as a world-class law school and an international centre of excellence. Although separated by history, culture and language legal scholars around the world can nonetheless readily recognise the high standards of excellence in legal scholarship of which you may be justly proud as represented, for example, by three of your most distinguished emeritus professors: Professor Jianping in Civil and Commercial
law, Professor Cheng Guangzhong in Criminal Law which is a field of special interest to me, and Professor Zhang Jin Fan a celebrated legal historian; and by Prof Xu Xianming, your energetic and engaging President, in Jurisprudence, another field of special interest to me and I was intrigued to learn from you, Mr President, when you recently visited Oxford that China does not need legal technicians so much as expertise in and understanding of legal principles. That is an educational challenge worthy of the fine traditions established in the first 50 years of this prestigious school of political science and law and we wish you every success.
I do not suppose that I will be present when this University celebrates its centenary but I can imagine that the next fifty years and indeed even the next fifteen will be very exciting for Chinese legal academics and practitioners.Some years ago I read a passage in a law report which I was studying in connection with the quaint common law doctrine of privity of contract that
I had not previously encountered and which caused me to reflect most carefully.The case is known as The Pioneer Container. It was heard by the Privy Council on appeal from the Court of Appeal of Hong Kong and is to be found in the Law Reports for 1994 in the second volume of Appeal Cases commencing at page 324. The legal question was whether sub-bailees were entitled to rely on an exclusive jurisdiction clause but the fascinating passage was "This bill of lading contract shall be governed by Chinese law". Hitherto the choice of law clauses which I had encountered always stipulated English law as the proper law of the contract. It occurred to me then that a knowing lawyer of the twenty-first century would have to have a working knowledge of Chinese as well as English contract law. That seems to me all the more pertinent in light of China's accession to the World Trade Organisation, a fact, Mr President which has greatly excited the interest of some of my colleagues in Oxford in law and legal education in China. I think that the time could not be more apposite for bringing these two legal cultures closer together.
For the purpose of bringing different legal cultures a little closer together and through the extraordinary generosity of Mr David Paterson - to whom I owe a personal vote of thanks and whose commitment to facilitating education of Chinese lawyers in English law I find most admirable - we are already admitting some very able Chinese students to read Law at Oriel College.
Permit me to name "Paloma" Wang, "Frank" Cui, and "Ruby" Li as three outstanding representatives of and ambassadors for CUPL. It is a delight for a tutor to assist such able and committed students. I therefore take this remarkable opportunity to thank their professors here in Beijing for the excellence of their teaching. It makes my own task very easy ! To those three soon will be added Chen Jian - known to me as "Matthew" - whose indefatigable efforts on my behalf promise to make my first visit to China enjoyable and unforgettable. He has arranged for me to visit the terracotta army near Xi'an and to cruise the mighty Yangtze River from Chongqing to Wuhan. He has done this with precision and with style. From what I have observed already of this young man, I am confident that he will make a great success of his legal studies at Oxford University. With your permission, Mr President, I thank him for all that he has done and I congratulate you and your colleagues on the quality of your graduates.
Saving what I hope is the best to last, I am pleased to be able to announce on this auspicious occasion that through that same generosity arrangements are now well in hand for a Professor from CUPL to come to Oxford as a Visiting Fellow.I think we all would wish to express thanks again to Mr David Paterson. It is, of course, contingent on the agreement of a distinguished visitors committee approving the professor selected and I understand that in order to facilitate matters I am to be involved in that selection process. I am sure that there are many suitable candidates and I think this is a remarkable opportunity for a member of this University, Mr President to explore English law and establish relationships with members of the law school in Oxford. I firmly believe that the more we can share and compare our legal cultures the better and I am delighted to be the bearer of news of this institutional gift. I hope that I have not taken up too much time and I close, as I began, with an expression of thanks, of congratulations, and of our warmest good wishes.
